Terms of Service
Effective: August 7, 2026
Welcome to Briklyst. These Terms of Service ("Terms") are an agreement between you and Briklyst LLC ("Briklyst," "we," "us") governing your use of the Briklyst website, storefront builder, and related services (the "Service"). By creating an account, claiming a storefront, or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
1. Who can use Briklyst
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service, and at least 18 to enter into monetized brand partnerships through it. If you use Briklyst on behalf of a business (for example, an agency managing storefronts for clients), you represent that you have authority to bind that business to these Terms.
2. Your account and handle
- You're responsible for activity on your account and for keeping access to your email secure, since we log you in with magic links.
- Handles (like yourname.briklyst.com) are first come, first served. Handles that impersonate a person, brand, or Briklyst itself, or that are reserved for technical or safety reasons, may be reclaimed or reassigned at our discretion.
- If you believe a handle impersonates you or your brand, contact support@briklyst.com with proof (an email from the brand's own domain or trademark documentation). We review these manually.
3. Agency-managed storefronts
Storefronts may be created and managed by an agency on a creator's behalf before the creator has an account ("unclaimed" storefronts). When a creator claims a storefront, ownership transfers to the creator, and the agency retains management access until the creator removes it. Agencies must have the creator's permission to create and operate a storefront on their behalf; as between the agency and the creator, the creator owns the storefront and its content.
4. Your content
- You own the content you add to your storefront (text, images, links). You grant us a worldwide, non-exclusive license to host, store, display, and distribute that content as needed to operate the Service (for example, serving your public storefront page).
- You're responsible for having the rights to everything you upload, including product photos.
- Parts of your storefront can be drafted by AI (titles, descriptions, layout). AI output is a suggestion: review it before publishing. You're responsible for what your storefront says.
5. Subscriber lists
- Email addresses collected through a storefront's signup block belong to the storefront owner, not to Briklyst and not to any agency. We hold them on the owner's behalf, we don't sell them, and we don't market to them ourselves.
- For a storefront managed by an agency, the agency may view and export the list while its management access is active, but as between the agency and the creator the list follows the storefront. When a creator claims a storefront, the list goes with it. When a creator removes an agency's access, the agency loses access to the list going forward.
- You can export your list as a CSV at any time from the studio.
- Whoever collects the addresses is the one responsible for how they're used, including consent, unsubscribe handling, and compliance with laws like CAN-SPAM and GDPR. Don't import addresses you didn't collect through the storefront.
6. Affiliate links and disclosures
- Briklyst tracks clicks on your links and may append tracking parameters (like SubIDs) so your clicks can be matched to affiliate reporting. We never take a cut of your commissions.
- You are solely responsible for complying with the terms of your affiliate networks and brand partners, and with advertising disclosure laws (such as FTC endorsement guides), including any required disclosures on your storefront and social posts.
7. Acceptable use
You agree not to use the Service to:
- impersonate any person or brand, or misrepresent your affiliation;
- link to or promote anything illegal, deceptive (including phishing or malware), or infringing;
- publish content that is hateful, harassing, sexually exploitative, or harmful to minors;
- artificially inflate clicks or interfere with the Service's operation or security, including probing, scraping at abusive volume, or circumventing limits.
We may remove content, suspend storefronts, or terminate accounts that violate these Terms, with immediate effect for storefronts used for phishing or scams.
8. The Service
- Free accounts include a set number of storefronts and per-storefront link and daily AI generation limits. The current numbers are shown in the studio when you hit them. Limits may change; we'll be reasonable about it.
- We may modify or discontinue features. If we ever discontinue the Service entirely, we'll give reasonable notice so you can export your links.
- Click statistics are provided as-is for your information; counts exclude traffic we identify as automated and may differ from other analytics tools.
9. Termination
You can delete your account at any time from Account settings. Your storefronts go offline immediately, and everything is permanently deleted 30 days later. You can cancel inside that window by logging back in. We may suspend or terminate accounts that violate these Terms or create risk for us or others. On termination, your published storefront comes down; we may retain records as described in the Privacy Policy.
10. Disclaimers
The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Service will be uninterrupted, error-free, or that any particular level of clicks, traffic, or earnings will result from using it.
11. Limitation of liability
To the maximum extent permitted by law, Briklyst LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenues, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of $100 or the amount you paid us in the 12 months before the claim.
12. Changes to these Terms
We may update these Terms from time to time. If a change is material, we'll notify you (for example, by email or an in-app notice) before it takes effect. Continuing to use the Service after a change means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Michigan.
